DESIGNATION
The marking of the characteristic points of a plot or building on the ground is called staking, which is also called "plot surveying". Staking a plot means marking the breakpoints of the plot boundary on the real estate registry map on the spot, usually with stakes.
When is it worth it?
Before building a new fence
When buying or selling real estate
If the location of the plot boundary is disputed
Before construction begins
Important information:
The boundary of a plot is primarily a legal concept, not a geometric one, therefore the demarcation of the plot determines the ownership of the land parcels. therefore, special regulations apply to these works. Only a land surveyor with a property management qualification can set the plot boundary.
Any owner or manager of a plot of land can order the marking of the plot if they want to fence it or if the position of the plot boundary is uncertain or disputed.
The owners of neighboring plots must be notified of the marking so that they can also participate in the marking.
If during the demarcation the surveyor determines overuse, i.e. the owner of a neighboring plot is using part of the demarcated plot, the neighbor must be called upon to settle the plot boundary by registered letter (with return receipt) together with a copy of the demarcation outline. This is also important to avoid the owner permanently losing the fenced-off part of the area due to possession!
If the neighboring owner refuses to return the illegally occupied part of the land, the land can be reclaimed through court proceedings.
